UFCW, Food Manufacturers Form Alliance on Senate Immigration Bill

UFCWnewsWASHINGTON, DC –The United Food & Commercial Workers International Union and the Food Manufacturers Immigration Coalition (FMIC) yesterday announced their partnership on comprehensive immigration reform in a letter sent to the Senate “Gang of Eight,” praising them for their efforts on S. 744. The labor-business coalition is also seeking improvements to the Senate bill in the areas of visa allocation and employment verification.

“We write in support of the comprehensive immigration reform process and thank you for your critical and constructive efforts in support of this legislation,” says the letter signed by UFCW International President Joe Hansen and Barry Carpenter of FMIC.

The labor-business coalition said they support the Senate bill’s provisions to establish a roadmap to citizenship, protect family based immigration, promote smart, effective border enforcement, implement a workable, transparent employment verification system, and create an occupational visa for non-seasonal, permanent positions. However, Hansen and Carpenter are also calling for commonsense improvements to S. 744 in the areas of visa allocation and employment verification.

The labor-business coalition asked for more flexibility when it comes to employment verification. “Allowing employers to use Self-Check in a uniform, nondiscriminatory fashion will create greater transparency for new employees, and will enable employers to ensure that their new hires are not circumventing E-Verify,” the letter reads.

Moreover, the letter outlined: “If an employer takes the extra step of deterring identity theft through the uniform use of Self-Check, then the employer should be presumed to have acted in ‘good faith’ with respect to the E-Verify confirmations it receives.”

Finally, the labor-business coalition requested that Senators direct the U.S. Departments of Homeland Security and Justice to create regulations that would provide specific rules of the road “describing a course of conduct…that satisfies employment verification requirements and concurrently avoids anti-discrimination liability.” “If an employer follows these regulations, then the employer is presumed to have complied with both the verification and anti-discrimination rules,” the letter reads.

The labor-business coalition said they look forward to working with the Senate to improve S.744 and seeing comprehensive immigration reform become the law of the land.

National Retail Justice Alliance Highlights Need for Part-Time Worker Bill of Rights in California

The National Retail Justice Alliance, in partnership with other stakeholders including UFCW Locals 5, 770, and 1428, hosted hearings last week in Oakland and Los Angeles with two Members of Congress—Barbara Lee and Judy Chu—to highlight the social and economic plight of part-time workers in retail and other service industries.

The hearings underscored the need for the Part-Time Worker Bill of Rights Act of 2013 (H.R. 675), which would ensure that part-time workers (defined as working less than 30 hours a week) and their families have access to critical workplace benefits.  The Affordable Care Act (ACA) penalizes employers who fail to provide health insurance to full-time workers, but includes no such penalties for employers who deny health coverage to part-time workers. The Part-Time Worker Bill of Rights would penalize employers for failing to provide health care to part-timers and thereby end the incentive for dropping workers from their coverage.

“Part-time workers across our nation need to come together and make their voices heard,” said Congresswoman Lee. “We cannot afford to go down a path where millions of Americans don’t have access to critical health care, retirement, and other benefits.”  “Millions of Americans are only able to find part-time jobs, and too many of these jobs do not provide health insurance, family and medical leave, or pension plans,” said Congresswoman Chu. “That’s why the Part-Time Worker Bill of Rights, which would extend benefits to part-time workers, is so critical. In today’s economy, we need to make sure that all hard-working Americans can afford to put food on the table and have a safety net to protect them and their families.”

Both Lee and Chu have signed on as cosponsors of H.R. 675.

In addition to the Members of Congress, state and local leaders, economic experts, and part-time workers also spoke at the hearings.

UFCW Members Lobby New York Legislators

UFCW members from local unions all across New York descended upon the Capitol in Albany today to lobby their elected officials about important bills pending in the Assembly and the Senate.

UFCW members lobbied in support of the New York DREAM Act, the Fair Elections Act, the Farmworker Fair Labor Practices Act, medical marijuana, and conveyed their strong opposition to the Walmart tax credit that was structured into the recently passed minimum wage deal.

For Isha Matko, a UFCW Local 1500 member who works at Gristedes in New York City, this was her first lobbying experience.

“We’re here to help bring a voice to more workers. This helps to ensure that Assemblymembers and Senators are seeing and hearing from real people. It’s a powerful experience being able to talk with people who have the ability to make a difference in all our lives.”

The real impact in lobbying comes from elected officials being able to attach a personal face to the bills that they vote on. Having a lobby day sends a strong reminder that they work for real people–not just the wealthy or big corporations. Juan Guardado, a UFCW Local 1500 member who works at Stop & Shop in West Islip, had a very personal reason for lobbying.

“I’m happy to be here because I really support the DREAM Act. I have a family member who is undocumented and despite getting straight A’s wasn’t eligible for any financial aid. He had to stop going to school because he couldn’t afford it. It’s important for working people to talk to their elected officials because they need to see firsthand that we care, we’re informed and we’re struggling.”

As the lobby day came to a close, UFCW Local One union representative Mark Manna of Buffalo hit on the true importance of the day.

“We’re working people. We don’t have $1,000 suits or a big checkbook, but we have a right to let our elected officials know what we’re concerned about. At the end of the day we keep score with votes, not with how much money is raised.”

Too often, when the word “lobby” is tossed around people immediately think “wealthy” and “special interest.” Yesterday in New York, UFCW members made sure their elected officials associated “lobby” with “workers.”

UFCW President Hansen Statement on NLRB Nominations

WASHINGTON, D.C. Joe Hansen, International President of the United Food and Commercial Workers International Union (UFCW), today released the following statement after President Obama made three nominations to the National Labor Relations Board (NLRB).

“Senate Republicans have made a mockery of their constitutional responsibility to advise and consent on nominations to the NLRB. Senator Lindsey Graham says the Board is out of control but it is his caucus that has made obstruction an art form. President Obama could nominate Mitch McConnell to the NLRB and Senate Republicans would still likely block him. Their motive is clear—they do not believe in the right to organize and resent that the agency charged with protecting workers is actually doing its job. Later this week, House Republicans will go a step further and consider a disgraceful bill to shut down the Board all together. The Senate now has before it a full package of nominees to the NLRB. It is time for Republicans to put ideology aside, do their job, and allow for prompt consideration. America’s workers deserve nothing less.”

Labor and Business Reach Deal on Employment-Based Visa Program

Over the weekend, labor and business reached an agreement which includes a new kind of worker visa program called the W-Visa. This is a key step in the push for comprehensive immigration reform.

The UFCW has been one of the main players in the negotiations, lobbying for reform that creates a process for determining the need and allocation of employment-based visas. The UFCW has said reform must establish a methodology for assessing labor shortages and determine the impact of visas on the economy, wages, the workforce, and business. This agreement meets those principles.

Under the new visa program, workers will have the ability to self-petition for permanent status after a year and they are not tied to a single employer. Unlike previous programs, this one is data-driven and will be staffed by experts in economics, labor markets, demographics and other specialties needed to identify labor shortages and make recommendations on the number of visas. Visa holders will be paid fairly, meaning their wages will not adversely affect the wages or working conditions of U.S. workers. They will be covered by state and federal employment laws to the same extent that other U.S. workers are covered.

This breakthrough will help move forward comprehensive immigration reform that creates a road map to citizenship for 11 million aspiring Americans.

UFCW locals spent last week meeting with their Members of Congress lobbying for comprehensive immigration reform. They are preparing for an all-out campaign once legislation is introduced to ensure its passage.

Iowa UFCW Locals Endorse Braley for Senate

WASHINGTON, D.C. Locals 222, 230, 431, 440 and 1149 of the United Food and Commercial Workers (UFCW) today announced their endorsement of Congressman Bruce Braley for the U.S. Senate.

“We are proud to endorse Bruce Braley for Senate,” the locals said. “He is a ferocious champion of working families and the middle class.  His experience growing up in Brooklyn as the son of a grain elevator operator and a teacher helped shape his passion for economic justice.”

In the House of Representatives, Braley has proven himself as a tough and smart leader. He has fought to ensure equal pay for equal work, strengthen the right to organize, and reform America’s broken immigration system.

“Bruce has been a rising star from day one—and the people of Iowa have benefitted,” the locals said. “He never forgets where he came from or who he represents.”

Braley is running to replace Senator Tom Harkin who is retiring after five outstanding terms of service. As Chairman of the Senate Health Education Labor and Pensions Committee, Harkin has put the needs of workers front and center. “Tom Harkin never stopped fighting for us,” the locals said. “We can think of no one better to follow in his footsteps than Bruce Braley.”

“We look forward to doing everything we can to help make Bruce our next U.S. Senator,” the locals said.

UFCW Members Hold Lobby Days in Ohio and Kentucky

UFCW Locals 75 and 227 hold a lobby day in Frankfort, Ky., to
educate legislators on “no rights at work” legislation.

Last Wednesday, UFCW members and staff from UFCW Locals 75, 1059, and the RWDSU gathered to speak out against right-to-work legislation during a lobby day in Columbus, Ohio.  Following trainings with UFCW local union and International staff on lobbying best practices, UFCW members went into their meetings with their state representatives and state senators.

“Reaching out to our legislators regarding issues important to working families is one of the most valuable things we can do,” said Local 1059 member Travis Long who works at Kroger. “It was great this year, and I look forward to more opportunities in the future.”

Both veterans of past lobby days and first-timers reported they had a positive experience. Many legislators requested more information on UFCW issues and several scheduled follow-up meetings back home in their districts to continue the dialogue with UFCW members.

Also that day, hundreds of UFCW Local 75 and 227 members educated their legislators about “no rights at work” legislation during a lobby day in Frankfort, Ky. Speaker Pro Temp. Larry Clark welcomed UFCW members to the Capitol and spoke against “no rights at work”.

The following day UFCW allies in the House Labor and Industry Committee exposed the flawed arguments of “no rights at work” proponents. Members also stood in solidarity with their brothers and sisters from the Kentucky Trades against an effort to remove prevailing wage from school projects.

Members ended the day with thank you letters to the legislators they had visited, along with “sorry I missed you” notes to legislators they were not able to reach. “Lobby day is a time for legislators to hear what is important to UFCW members,” said Jeff Pleasant, assistant chief steward at JBS. “Our lobby day has grown every year, and we will continue to fight to keep ‘no rights at work’ out of our state.”

UFCW Kicks Off Campaign for National Comprehensive Immigration Reform

The UFCW recently kicked off its public campaign for  comprehensive immigration reform. Civil Rights and Community Action Department Director Esther Lopez says she expects a bill to be introduced in March or April, followed by hearings in May or June, and a vote in August.

In addition, over 80 UFCW leaders have signed a letter to President Obama in support of comprehensive immigration reform.

“The time to create a principled, legal immigration system that treats all immigrants with respect and dignity is right now,” the letter read.

Immigration reform rallies are being planned across the country. If you live near any of these major cities, be sure to support the cause! And if you don’t, gather a group of coworkers and friends and let political leaders in your area know that the time for immigration reform is now.

UFCW Pushes for Part-Time Worker Bill of Rights

Last week, Congresswoman Jan Schakowsky (D-Ill.) introduced the Part-Time Worker Bill of Rights which would help eliminate the incentive for employers to drop health coverage for their part-time workers. The Affordable Care Act (ACA) penalizes employers who fail to provide health insurance to full-time workers but includes no such penalty for part-timers (defined as working less than 30 hours a week).

This loophole has driven some national employers to announce plans to reduce workers’ hours in order to avoid the penalty.  Walmart dropped part-time health coverage last year.   The Part-Time Worker Bill of Rights seeks to level the playing field and protect the millions of part-time workers in retail and other service industries.

Workers are encouraged to contact their Members of Congress this week while Senators and Representatives are in their home states and districts. You can find the full text of the bill here.

The UFCW continues to use every avenue possible—whether through the regulatory process or legislation—to strengthen the ACA and protect quality, union-negotiated health benefits. The Part-Time Worker Bill of Rights is a part of that effort.
